Since you've included the screenshot of our chat, then I'll add my two cents on the matter.
Using my personal opinion as evidence to prove a point falls short when it's a personal opinion, as it doesn't make something necessarily true. You asked me if someone who's been punished 41 times is a minge to which I replied "yeeeeeh prob" as in "yeah probably". Now, I need to point out that "
probably" is not the same as "
definitely".
The ban you're appealing states:
Quote:You are entitled to your own opinions. But I will not tolerate insults in that manner.
Now, I'm entitled to my opinions, and you are entitled to yours, and that's all fine and dandy. That makes you an individual. Congratulations with that. The issue of the matter is
how you express said opinions, whether it's acceptable to do so, and if so how you do it. Clearly, we have rules regarding how someone can express their opinions on our services. While you have the right to dislike someone, that doesn't mean the right to disrespect them. Again, there's a big difference. You've been banned from the forums because of how you chose to express your opinion, and because it's against how we wish individuals to express themselves. Everyone can express themselves as long as it's done in a respectable and acceptable manner. While I'm okay with you calling me "mther bitch" and you're okay with me calling you a "fucking cunt" or whatever over Steam is one thing, but the same would not be okay on our services on Limelight, that being on the forum or ingame. You're banned because you expressed yourself in a way that was found to be disrespectful towards another community-member.
Even
IF the player you called a "big minge" (on an UBR where you're not allowed to post unless you're involved to begin with mind you) is actually a big minge is one thing, but making an insult to a player in a forum-area
where you're not allowed to involve yourself is another thing.
The issue of the matter doesn't lie with if someone is a "big minge" or not. The issue lies with you blatantly ignoring a clearly written and well-known rule. Especially something that should be true with someone like yourself who has enough experience to know better.
You went against the rules knowing that it was against the rules, knowing that there can be consequences to going against the rules. You went against the rules accepting the risk of consequence. You can't complain about the consequence when you were aware of said possible consequence, and when it was entirely your choice to risk the consequence or not.
Your entire case here is about trying prove if a certain community-member is a minge (as you claim) or not. The case itself isn't about wether the community-member is a minge or not. The case is about how you expressed yourself in a disrespectful way in an area in which you're certainly not allowed to post.
Risk it for the memes and your name will end up beside a written punishment.
So to recap:
1. You were disrespectful towards a community-member.
2. You went against clearly written forum-rules, posting in a place where you shouldn't have.
3. The blame lies with you. Not the community-member you're trying to prove is/was a minge. Not with Daley.
You were warned where not to fly. You flew there. Your wings melted. You can't blame others for doing something that is ill-adviced, Icarus.
We can have more of these cases where you quote me (with my permission as you did), but that will also means that I'll give my 20 cents in a thread which is not mine, nor one where I'm involved to begin with. Clearly, my 20 cents are not in your favour this time.
We should do this more often.
I will not conclude this thread as you requested as I didn't issue the punishment, but I don't believe the outcome would be in your favour. I'll leave that to Daley.
Epilogue:
If a certain player has a record of breaking forum-rules and continues to break the same ones again and again on purpose. Does that make him a minge?
