In his video you can clearly see he was trying to look at you, he wasn't staring at a wall.
As to how can he be a threat: he did gun you down, did he not?

In the first clip, it's a clear breach of fearRP.
Second clip, bit debatable but its still fearRP.
I don't really see a reason to approve this appeal.
